XP Stream Tools provides stream overlay licenses and related creator tools for platforms including Twitch, Kick, YouTube, and TikTok.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.
License Grant
We grant you a limited, non-exclusive, non-transferable license to use purchased overlays for your own streaming activities.
One License, One Buyer
A license is intended for use by a single buyer across that buyer's own streaming channels.
Channel Binding
Licenses may be associated with channel names specified during activation.
Restrictions
You may not:
- Share or transfer licenses
- Reverse engineer overlays or systems
- Circumvent security or licensing protections
- Use the Service for unlawful activity
- Abuse, disrupt, or interfere with the Service
We reserve the right to investigate suspected abuse, fraud, unauthorized access, or license sharing.
Purchases, Payments, and Refunds
Purchases may be processed through third-party platforms such as Etsy.
Future subscription-based features may include additional billing and renewal terms presented at the time of purchase.
Refunds are governed by our Refund Policy.
Third-Party Platforms
The Service may integrate with Twitch, Kick, YouTube, TikTok, OBS, StreamElements, and other third-party services.
We are not affiliated with or responsible for third-party platforms.
We do not guarantee uninterrupted compatibility with third-party platforms, APIs, or integrations that may change outside our control.
Intellectual Property
All overlays, software, branding, graphics, and related materials remain the property of XP Stream Tools or its licensors.
You retain ownership of your own stream content.
Termination
We may suspend or terminate access for violations of these Terms, fraud, abuse, chargebacks, or legal compliance reasons.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XP STREAM TOOLS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Dispute Resolution
Before filing any formal legal claim, you agree to first contact us at support@xpstreamtools.com to attempt a good-faith resolution of any dispute. We will respond within 30 days of receiving your notice.
If the dispute is not resolved through informal negotiation within 60 days, either party may pursue further legal remedies in accordance with the Governing Law section below. Nothing in this clause prevents either party from seeking injunctive relief in a court of competent jurisdiction at any time.
Governing Law
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of laws principles. Any legal action arising from these Terms will be brought in the courts located in Illinois.
Changes to Terms
We may modify these Terms from time to time. We will notify users of material changes via email (to the address associated with your account, if any) or by posting a prominent notice on the Service. The "Last Updated" date at the top of this page will reflect the most recent revision.
Your continued use of the Service after notice of changes constitutes acceptance of the updated Terms.
